NHRC DG(I) to investigate Custodial Death in Odisha Jail

Bhubaneswar: National Human Rights Commission has taken serious note of an under-trail prisoner death in Alipingal jail of Jagatsinghpur District. The Commission Order it’s Director General (Invetstigation) to inquiry into the matter and submit its report within eight weeks.

One Aravind Mallick, an under-trail prisoner was suspiciously dead in Alipingal Sub Jail under Jagatsingpur District on March 02. He is in Alipingal Jail from 9th December, 2011 and found dead on March 02, 2012 in Jail. According to Jail official his body was found in the Latrine room of the Jail. He was brought dead to the District Headquarter Hospital in Jagatsingpur with Hand cupped. Managing Trustee of Pipili based Organization ‘India Media Centre’ and Human rights activist Mr. Akhand filed a petition in the case alleging that due to torture or negligence on part of jail officials or gang war among prisoners, Arvind is dead. This death case was reported to NHRC by Collector and District Magistrate of Jagatsinghpur. So the commission clubbed the petition of  Akhand with first file and pass a order to DG(I) to investigate the matter by collecting the facts and requisite reports and submit the final report within eight weeks. One Siba Sankar Patro of Ganjam also filed third petition in this case. All the three cases are clubbed together and commission is waiting for the report from DG(I).

Rehabilitation Package for Displaced Persons

The land acquisition for National Highways is done under the provisions of the National Highways Act, 1956 which involves due consultation with the stake holders as per the provisions of the Act. Highways are linear projects that involve widening of existing roads and opening of new road for bypasses, and have a long and narrow corridor of impact. The linear acquisition of land results in minimal displacement of families and loss of livelihood. On the other hand, development of highways results in the socio-economic development of the area, ultimately benefiting the local population.

Relevant provisions of National Policy on Rehabilitation and Resettlement, 2007 in relation to Land Acquisition of National Highways provides that in case of linear acquisitions, in projects relating to railway lines, highways, transmission lines, laying of pipelines and other such projects wherein only a narrow stretch of land is acquired for the purpose of the project is utilized for right of ways, each khatedar in the affected family shall be offered by the acquiring body an ex-gratia payment of such amount as the appropriate Government may decide but not less than twenty thousand rupees, in addition to the compensation or any other benefits due under the Act or programme or scheme under which the land, house or other property is acquired. Provided that, if as a result of such land acquisition, the land-holder becomes landless or is reduced to the status of a ‘small’ or ‘marginal’ farmer, other rehabilitation and resettlement benefits available under this policy shall also be extended to such affected family.

This information was given by the Minister of State of Road Transport and Highways Shri Jitin Prasada, in a written reply in Rajya Sabha today.

Baby Falak dies at AIIMS

Two-year-old battered baby Falak, whose harrowing ordeal shocked the country, died at AIIMS last night following a cardiac arrest after fighting a grim 58-day battle for life.

The abandoned child, who was admitted to the AIIMS on 18th January with severe head injuries, broken arms, bite marks all over her body and cheeks branded with hot iron, breathed her last at 9.40 PM, doctors said.

“It was unexpected. She was fit to be discharged. All of a sudden, she had a cardiac arrest at nine and we tried to revive her. But then she gave up at around 9.40 PM,” said Deepak Agrawal, Assistant Professor of Neurosurgery at the AIIMS Trauma Centre who has been attending on her from the day she was admitted there.

During her treatment earlier, she had contracted meningitis and underwent five surgeries and had also suffered two heart attacks.

“But she had survived all this and had recovered well,” Agrawal said. “She was doing well. We removed her from the ICU and shifted her to the ward after we found that she had recovered well.

The whole day she used to spend time playing with the nurses at the hospital.

“All of a sudden she had a cardiac arrest. Since she is a medico-legal case, we will conduct a post-mortem tomorrow,” Agrawal said.

The child was brought to the hospital by a teenaged girl, who had falsely claimed to be her mother.

Investigations revealed the shocking story of Falak, her two siblings and their mother who were all separated after falling victim to human traffickers.

Falak’s mother Munni was tricked into a second marriage by three women out of whom two — Laxmi and Kanta Choudhry — were arrested.

The trio had promised that her three children will be taken care of but they were left to different people.

Ten people were arrested in the case, including the man who had abandoned the child with his teenaged girlfriend.

Police traced Falak’s five-year-old brother from the house of a vendor in West Delhi’s Uttam Nagar locality while her sister Sanobar was traced by Delhi Police to Muzaffarpur in Bihar.

On 15th Februray, Falak was reunited with her 22-year-old mother Munni, who was married to a man in Rajasthan.

Media persons boycott Orissa Assembly proceedings

The media persons of Bhubaneswar boycotted the proceedings of Odisha Assembly today as a mark of protest against apathy of the state government towards rising attack on journalists in the state.

Not a single media person covered the question hour of the House and even Orissa Television (OTV) which telecasts the proceedings live switched off the cameras to express solidarity with the Media Unity for Freedom of Press (MUFP) which had given the boycott call on Thursday during its demonstration before the Assembly in an attempt to wake up the Naveen Patnaik Government which is ignoring repeated demands of MUFP to punish the assaulters and ensure safety and security of the working media persons in the state.

For one hour, the media persons did not enter to the press gallery of the Assembly and squatted before the entrance to the gallery silently.

Bhupinder Singh, Leader of Opposition came near the squatting media persons and extended the support of the opposition to the cause of the media persons in the state.

On behalf of MUFP, senior journalist Prasanta Patnaik congratulated all media persons for taking such a historic step to express solidarity for the cause of the media and freedom of press which was in danger as the state government and its police were acting against the interest of the media persons.

The MUFP also expressed gratitude to the Editors, media houses and TV channels for supporting the cause of media unity for freedom of press.

Journalists to boycott Orissa Assembly on July 16 in protest against attack on media

Media Unity for Freedom of Press (MUFP) has resolved for token boycott of the proceedings of Orissa Assembly during the question hours on Friday, 16th July, 2010 to register protest against rising attack on media persons in the State, and to create awareness among the public representatives to put pressure on the Government for creating an atmosphere of harmony to ensure freedom of press and safety of the media persons.

MUFP demonstration held as scheduled on Thursday  forenoon was a huge show of solidarity of all media persons in cause of freedom of press and with journalists attacked by men in uniform and miscreants in nexus with them.

The media persons with placards and slogans demonstrated their wrath on the Mahatma Gandhi Marg  before the assembly over administrative apathy to their demands for action against hooligans –official and private – in instances of assault and intimidation resorted to by them to gag the press.

They were shocked to know that the two uniformed men apprehended by the local police for misbehaving with a lady reporter on duty at ISKON car festival point and for injuries inflicted upon her accompanist cameraman Mr. Debasis Mallick , including destruction of his camera were enlarged due to inability of the police in prosecuting them. They demanded stern and exemplary action against non-prosecution of the rowdies in uniform in the instant case and called upon the state administration as well as the assembly in session to wake up against the alarming transgression of freedom of press.

The policeman who had brutally assaulted Dainik Bhaskar journalist Mr. S. Raiv Gourav have also so far not arrested. Though the police claim that they are unable to identify the culprit, photograph of the assaulter  is available with many media men.

They resolved to carry out a token boycott of the Assembly proceeding for one hour when the House commences on July 16 in protest against inaction against the transgressors of freedom of press.

MUFP has thanked all media persons for their historic solidarity and has called upon the reporters ,cameramen Editors and the promoters of media houses , including TV channels to stand united in the token boycott of the Assembly proceedings in the first hour of July 16.
